Reasonably Available Control Technology (RACT) III Hearings

The Reasonably Available Control Technology (RACT) standards were created to satisfy the 2015 National Ambient Air Quality Standards (NAAQS) for ozone. The NAAQS are established by the U.S Environmental Protection Agency (EPA) as the maximum concentrations in the atmosphere for specific air contaminants to protect public health and welfare. The RACT requirements apply statewide to the owner or operator of any major Nitrogen Oxides (NOx) emitting facility, any major Volatile Organic Compounds (VOC) emitting facility or both when the installation/modification of the source(s) occurred on or before August 3, 2018. The facilities listed below are seeking approval from the EPA for their proposed revised State Implementation Plan (SIP).


Public Hearings

All hearings for facilities seeking SIP revisions will be held in DEP's Southeast Regional Office, located at 2 E. Main St. Norristown, PA 19401. Those wishing to provide comments at the hearings are asked to contact Robyn Briggs, Regional Communications Manager, at robbriggs@pa.gov or 484-250-5965, at least one week prior to each hearing. Oral testimony will be limited to 10 minutes per individual and two written copies of the oral testimony are requested. Each organization is asked to designate one presenter per group.

If there is no public interest in a particular facility, the hearing will be canceled. Written comments for each facility will still be accepted to the DEP's Southeast Regional Office during the periods listed below.

Innovation (Innovation) 411 Fee Owner LLC

A public hearing will be held on Monday, May 19, 2025 2:00 PM-3:00 PM at the DEP’s Southeast Regional Office located at 2 East main Street, Norristown, PA 19038.

Located in Upper Merion Township, Montgomery County, operates boilers, electric generators, fuel storage tanks, research and ancillary equipment under the Title V Operating Permit (TVOP) 46-00299 and is categorized as a major source of nitrogen oxide (NOx) emissions.  In accordance with the regulations, promulgated at 25 Pa. Code §§ 129.111-129.115, the RACT III requirements apply to a major NOx-emitting facility that commenced operation on or before August 3, 2018.

Innovation has proposed a NOx emission limit of less than 5 tons per year on each of there (3) emergency generators (EGENS), along with an individual No. 2 fuel oil limit of 12,500 gal/yr, calculated on a 12-month rolling basis. These changes to the TVOP will allow these three (3) EGENs to qualify for the presumptive RACT III requirement (25 Pa. Code §129.112(c)(10)), which requires that the EGENs be operated in accordance with manufacturer’s specifications and good operating practices.

Speakers must pre-register to testify at the hearing.  The last day to pre-register to speak at the hearing will be May 16, 2025. Monroe Energy, LLC

A public hearing was held on January 30, 2025, at 6:00 PM at the Marcus Hook (Curt Weldon) Community Center, 7 W. Delaware Ave, Marcus Hook, PA 19061 to accept oral comments on the proposed RACT III Alternate Proposal and the proposed SIP revision for Monroe Energy, LLC. Title V Operating Permit No. 23-00003, for operations located at 4101 Post Road, Trainor, PA  19061.

Wheelabrator Falls, Inc.

A public hearing was held on May 29, 2024 at 10:00 A.M. at the DEP Southeast Regional Office, 2 E. Main Street, Norristown, PA 19401, where verbal comments were accepted for the proposed RACT III Alternate Proposal and the proposed SIP revision for Wheelabrator Falls, Inc. Title V Operating Permit No. 09-00013, for operations located at 1201 New Ford Mill Rd, in the Township of Falls, Bucks County.
