​​​​​2025 Workers' Compensation Special Schedule "W" Data Call

The Pennsylvania Insurance Department is conducting its annual workers' compensation Special Schedule "W" data call. Authority for this data call can be found in Section 655 of the Insurance Company Law of 1921, P.L. 682, as amended, 40 P.S. § 815.

About the Data Call

This data call is due April 16, 2026.​

The data call's cover letter, general instructions, and instructions for constraints affecting unpaid claims estimates are available under the Resources section. The Pennsylvania Compensation Rating Bureau's (PCRB's) Financial Data Manager (FDM) should be used to report all Special Schedule W information (including Coal Mine experience). This is in place of any submission directly to the Pennsylvania Insurance Department. Refer to the PCRB's website for further information on reporting workers' compensation experience for Special Schedule W via the FDM.

The premium and loss experience reported on Schedule “W” is used to determine the assessments that fund the Subsequent Injury Fund, the Supersedeas Fund, the Workers' Compensation Administration Fund, the Uninsured Employers Guaranty Fund and the Office of Small Business Advocate. Specifically, the premium and loss information within the deductible layer that is reported on Schedule “W” is used in the assessment calculations, along with premium and loss information that is reported net of deductible business. Your company’s share of the total assessed amount for each fund is based on the premium and loss information reported on Schedule “W”. Please refer to 77 P.S. §§ 1000.2(b), 1041.3(a) and 2707, 71 P.S. § 578, and 34 Pa. Code §§ 121.22, 121.23 and 123.31 for further information about how these assessments are calculated using the information reported on Schedule “W”.

It is imperative that insurance companies writing workers compensation insurance in Pennsylvania complete Schedule “W” accurately and on-time. Please note that Section 655 of The Insurance Company Law of 1921 (40 P.S. § 815) provides that any insurance carrier that fails to submit a timely Schedule “W” “shall forfeit one hundred dollars for each day during which such neglect continues, and, upon notice by the Insurance Commissioner, its authority to do business shall cease while such default continues.''  The Department plans to begin enforcement of penalties, as authorized by law, for any instances of late reporting beginning with this Schedule “W” Data Call due April 16, 2026.

Submission Process​​

All carriers that must provide the Constraints Affecting Unpaid Claims Estimates file should do so in a pdf file named "constraints.pdf". This submission should be made to the PCRB only via the FDM no later than April 16, 2026.
