USDA Bid Solicitations and Milk Sales to USDA
Pursuant to the Pennsylvania Milk Marketing Law, the Pennsylvania Milk Board establishes and enforces minimum wholesale and retail prices for fluid milk and cream products. It is a violation of the Milk Marketing Law to offer to sell and to sell milk at a price below the minimum price fixed for the particular transaction. This includes bids and sales involving USDA.
Board Bulletin 1597 describes in detail the Board enforcement policy regarding USDA solicitations and legal bids. Briefly, bids must be made for a price at or above the minimum wholesale price (minus applicable discounts) for the month in which the bid is due.
The following products are price-regulated by the Board. The Board-established minimum prices apply to these products, whether fluid, evaporated (evaporated milk in a hermetically sealed container is not price-regulated), organic, or UHT.

When USDA invites bids for products regulated by the Board, we will produce a spreadsheet showing the minimum legal bids for each product in each Pennsylvania Milk Marketing Area. The spreadsheet will be posted on this webpage and emailed to eligible vendors as provided to us by USDA. You may also request to be placed on a distribution list to receive the minimum legal bid spreadsheet each time we issue one.
The Board has also sent three letters regarding bids for USDA and other federal contracts to eligible vendors that we are aware of. Those letters are linked below for your convenience.

On August 7, 2024, USDA solicited bids to sell Ultra High Temperature Milk Products (Description 12-3J14-24-B-0583, Bid invitation number 2000010290) for use in the domestic food distribution programs. Bids are due by August 21, 2024.
The Pennsylvania Milk Marketing Law provides that milk may not be offered for sale at a price below the Board-established minimum price.
