The Pennsylvania Supreme Court recently ruled that a mandatory life sentence for all individuals convicted of 2nd degree felony murder is unconstitutional. The Court decided that a sentence of life without parole may be appropriate for those convicted of second-degree murder in some circumstances but might not be appropriate where the individual did not kill, had no intent to kill or was otherwise not directly responsible for the loss of life.
This case has the potential to impact many victims of violent crimes. Victims also have an opportunity to let their voices be heard by contacting state representatives. This is important because as part of the court decision, the Court gave the state legislature 120 days (July 24, 2026) to consider how to address this issue.
