Position Purpose: Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 


Provides legal support within the Office of Chief Counsel, Bureau of Liquor Control Enforcement, Pittsburgh office, to ensure its operations are conducted efficiently and effectively.

Description of Duties: Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

  • 70% Prepare pre-hearing memoranda for review and approval by attorneys. The pre-hearing memos detail all testimony and documentary evidence and exhibits to be introduced by the assigned Bureau attorney before a hearing is scheduled by the Office of Administrative Law Judge (OALJ). As such, they are critical to the prosecution of the Bureau’s cases. In preparing the memos, the Legal Analyst is required to carefully gather information from the investigative report and attachments, and is expected to proactively reach out to the investigating officers if there are any ambiguities or discrepancies. Further, the Legal Analyst is expected to spot any potential evidentiary or legal issues that may arise with the case and inform the assigned attorney for appropriate action.

  • 20% As requested, assist attorneys in preparation of motions and petitions (e.g., Motions to Withdraw or Amend Citations, Motions for Continuance, etc.) and briefs to the OALJ, PLCB, courts of common pleas, or the Commonwealth Court. Also, assist the attorneys in handling cases involving the Uniform Firearms Act, as deemed appropriate by the attorneys.

  • 10% Conduct legal research and draft memos as needed by the attorneys in the office and/or Deputy Chief Counsel, which may include issues involving the Liquor Code and the regulations of the Pennsylvania Liquor Control Board (PLCB), the Crimes Code, the Local Option Small Games of Chance Act, the Bingo Law, and other laws and regulations related to licensed establishments.

Example: In response to a customer inquiry, this work involves researching the status of an activity and preparing a formal response for the supervisor’s signature.

Employee uses decision making skills preparing pre-hearing memoranda as to which important facts of the case should be included or excluded, and spotting potential evidentiary or legal issues for the assigned attorney. Employee also uses decision making skills in drafting memos for the assigned attorney or REU.
